Action commenced on September 3, 1948, by United Gas, Coke & Chemical Workers of America, Local 18, affiliated with the C.I.O., plaintiff, against Wisconsin Employment Relations Board and Milwaukee Gas Light Company, a corporation, defendants, for a declaration of the rights, status and legal relations of the parties under ch. 414, Laws of 1947, subch. III of ch. 111, Stats., relating to the settlement of labor disputes between public utility employers and their employees and for a declaration that said act is unconstitutional. In an amended complaint Thomas Lansing, president of said labor union, was made a plaintiff. The defendants demurred to the amended complaint. The trial court sustained the demurrer. From a judgment entered January 6, 1949, dismissing the complaint, the plaintiffs appeal. The allegations in the amended complaint will be summarized in the opinion.
